Maine LD 2106: An Act to Prohibit the Disclosure of Nonpublic Records without Proper Judicial Review
The following testimony was submitted to Senator Anne Carney, Representative Amy Kuhn, and members of the Committee on Judiciary of the State of Maine on January 27, 2026.
As a supporter of the non-profit organization Maine AllCare and its advocacy of publicly funded universal health care, I support state and federal government taking a greater role in health care to ensure good health care for all Americans. At the same time, I am increasingly concerned about intrusion of government agents into health care facilities and their data bases for purely immigration-related reasons. Such intrusion should be allowed only if, as specified in LD. 2106, "a valid judicial warrant authorizing entry into a nonpublic area of a health care facility or a search of patient records or compliance under exigent circumstances." Without this restriction on government agents, more and more patients will reduce engaging with the health care system, endangering their own health and adding to the burden of advanced disease the system must deal with.
